These Terms govern use of the public ADUBuilderConnect website and any non-contractual browsing features. Contractor marketplace participation, lead purchases, subscriptions, and homeowner-data access are also subject to the Contractor Marketplace Agreement and Lead Purchase Terms, which control if there is a conflict.
1. Marketplace operator only
ADUBuilderConnect operates a technology marketplace and lead-routing service. We are not a construction contractor, architect, engineer, construction manager, broker, lender, insurer, permitting authority, employer, joint venturer, or guarantor of any contractor or project.
2. No guarantee of opportunities
Directory placement, marketplace membership, subscription level, verification status, ZIP coverage, or prior lead history does not guarantee any minimum lead volume, ranking, response, project award, revenue, margin, exclusivity, or return on investment.
3. Credential information
Credential labels reflect only the review steps actually completed. Contractors remain responsible for maintaining all licenses, registrations, insurance, bonds, permits, tax registrations, and professional qualifications required for their work. Verification may be suspended or removed at any time if records expire, become inconsistent, or cannot be confirmed.
4. Intellectual property
The Service, software, design, branding, text, graphics, and documentation are proprietary or licensed. You may not copy, scrape, reverse engineer, resell, frame, or exploit the Service except as expressly permitted by law or written agreement.
5. Prohibited conduct
- Unauthorized access, credential sharing, scraping, harvesting, probing, reverse engineering, denial-of-service activity, or circumvention of technical controls.
- Misrepresentation of licensing, insurance, project history, pricing, identity, or customer reviews.
- Resale or redistribution of leads or homeowner information.
- Using homeowner data for unrelated marketing, discrimination, harassment, or unlawful communications.
- Uploading malware, infringing content, or fraudulent payment information.
6. Third-party services
Hosting, authentication, payment, email, SMS, database, analytics, and other services may be provided by third parties. Their terms and availability apply. We are not responsible for third-party outages or acts beyond our reasonable control.
7. Disclaimer
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE WEBSITE AND MARKETPLACE ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, LEAD QUALITY, CONVERSION, OR BUSINESS RESULTS.
8. Limitation of liability
To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages; lost profits, revenue, reputation, opportunities, data, or anticipated savings; contractor-client disputes; construction losses; regulatory penalties caused by a contractor’s conduct; or third-party acts. Contractual caps applicable to paid marketplace services are stated in the Contractor Marketplace Agreement.
9. Changes and termination
We may change public website features and these Terms prospectively. We may restrict or terminate access for abuse, legal risk, fraud, security concerns, nonpayment, or violation of our agreements.
